Heard learned counsel for the petitioner.
Notice on behalf of respondent no. 1 has been accepted by the office of Chief Standing Counsel.
In view of order proposed by the court, issuance of notice to respondent no. 2 is dispensed with.
The matter relates to the mutation proceedings. The name of the petitioner came to the recorded on the death of her husband by means of order dated 29-01-2019. Thereafter, an application has been moved by the private-respondent no. 2 whereupon the order dated 29-01-2019 has been stayed. It is in the aforesaid backdrop, it is prayed that the said mutation proceedings be decided expeditiously..
Having considered the submissions of learned counsel for the petitioner and from perusal of the extract of the ordersheet,which has been brought on record as Annexure No. 8 to the writ petition, this court is of the opinion that ends of justice can be met by directing respondent no. 1 to consider and decide the pending mutation case most expeditiously without granting any unnecessary adjournments to either of the parties after affording full opportunity of hearing within a period of four months from the date a certified copy of this order is placed before the court concerned.
It is made clear that this court has not examined the case of either of the parties on merits and the court concerned shall consider and decide the same expeditiously strictly in accordance with law.
With the aforesaid observations/directions, petition is disposed of.
