Mr.E.Bagath Singh, learned Special Government Pleader takes notice for the respondents.
In identical circumstances, this Court has passed following order on 02.06.2022 in W.A.No.1422 of 2022, directing the respondents therein to return the original certificates of the petitioners.
“All the petitioners herein are non-service post graduates in various specialities, who are challenging the order of learned Single Judge, wherein it was recorded that since the petitioners had executed a bond for a period of two years, they are bound to serve in the Government Hospitals. However, it is seen that the Director of Medical Education has passed an order dated 21.04.2022, instructing the respective Deans of the Government Medical Colleges to return the original certificates to similarly placed Post Graduates, which fact was recorded in an order of the Coordinate Bench in Writ Appeal No.1182 of 2022 dated 27.04.2022 in the following manner:
"3.During the pendency of this Writ Appeal, the second respondent herein passed an order dated 21.04.2022 instructing the respondent Deans of the Government Medical Colleges to return the original certificates to the appellants. In other words, the State Government complied with the direction and accordingly, nothing survives for consideration in this appeal."
The learned Government Advocate on instructions submitted that the counselling for the non service post graduates of various specialities is proposed to be held on second week of June 2022 and third week of June 2022.
In view of the orders passed by the Director of Medical Education instructing the Deans of Government Medical Colleges to return the original certificates, there shall be a direction to the respondents to forthwith return all the original certificate and documents belonging to the Appellants within a period of one week from the date of receipt of copy of this order. However, this order shall be subject to the final decision to be taken in the Writ Appeal.
Post the matter on 29.06.2022.”
In view of the order passed above, the petitioners herein also would be entitled for a similar relief. Accordingly, there shall be a direction to the respondents to forthwith return all the original certificates and documents belonging to the petitioners within a period of one week from the date of receipt of a copy of this order.
Post this writ petition on 08.06.2022.
