Judgment
Savitri Ratho, J
This application under Section 482 of Cr.P.C. has been filed by the petitioner for quashing the proceeding in G.R. Case No.18 of 2022 in the Court of the learned J.M.F.C., Kujang.
Mr. G.Mukharjee, learned Senior Counsel submits that even accepting the allegations to be true, no offences under Sections 323/294/506/354 (I) (II)/354/509 IPC have been made out against the petitioner, but the learned Magistrate vide order dated 11.5.2022 has mechanically taken cognizance of the said offences. Although there is no direction in the said order for issue of summons, Mr. Mukharjee, learned Senior Counsel submits that the petitioner has received summons from the Court. He further submits that in the enquiry conducted by the Internal Committee, the petitioner has been given a clean chit and copy of the said report has been annexed as Annexure-2.
Considering the above submissions, Mr. D.Nayak, learned Additional Government Advocate is directed to obtain the case diary.
List this matter in the week commencing 28th November, 2011.
