Justice Kurian Joseph, C.J.—Petition is filed with the following prayers:-

1) That the writ of Mandamus may be issued by directing the respondent No. 1 to issue the formal recognition under clause 7(11) of NCTE regulation 2009 for current academic session of 2012-13.

2) That the writ of Mandamus may be issued by directing the respondent No. 2 to grant affiliation for M.Ed. Course for current academic session of 2012- 13.

3) That the respondent No. 2 may be directed to arrange the counselling for petitioner institute for filling the 35 seats of M.Ed. course.

During the pendency of the writ petition pursuant to the directions issued by this Court, the NCTE has now given the recognition to the petitioner for starting the M.Ed. Course for the Academic year 2013-14. According to the petitioner, the steps for starting the above course have already been taken including appointment of staff etc. during the current Academic year 1012- 13. It is further submitted that the counselling for admission to the course is still going on.

Learned counsel appearing for NCTE submits that as per the Regulations, now in force, the recognition granted after 30.6.2012 would only be applicable for starting the course in the next academic year 2013-14.

This is a case where the petitioner has been applying for recognition ever since 2010 and there is no delay on the part of the petitioner. Since the petitioner-Institute has been found fit by the NCTE for starting the course and the petitioner has already taken steps for starting the course during the current academic year and the counselling is still going on, it will be appropriate that the 1st respondent considers the case of the petitioner favourably and grants permission for starting the course during the current Academic Session 2012-13.

In the above circumstances, there will be a direction to the 1st respondent to pass appropriate orders in the light of above observations hereinabove in the next NCTE meeting. In view of the above, the writ petition is disposed of. Pending application(s), if any, shall also stand disposed of.
