Adv.Sri.Saju N.A. the learned counsel appearing for respondents 5 to 8 submits that the writ petition has become infructuous.
This writ petition relates to a joint venture agreement entered into between the petitioner and respondents 5 to 8 to construct a multi storied
apartment complex along with the reconstruction of the houses. A writ of mandamus is sought for to grant renewal of building permit. Since, it is
submitted that the land owners had backed out of the joint venture and have already constructed their respective individual buildings in the property the
contract between the petitioner and respondents 5 to 8 have become frustrated and nothing survives in this writ petition as a cause for issuing a writ of
mandamus.
The learned counsel for the petitioner Adv.Sri.L.Rajesh Narayan Iyer, though sought time for getting instructions. I am of the view that taking note of
the pleadings in the writ petition and the submission of the counsel for the respondents, this writ petition has become infructuous.
Accordingly, this writ petition is dismissed as infructuous.
