NAVIN CHAWLA, J. (ORAL)
This petition has been filed by the petitioner, challenging the Orders dated 28.08.2023, 05.09.2023 and 12.09.2023 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi (hereinafter referred to as the, ‘Tribunal’) in C.P. No.162/2023 in O.A. No.174/2023, titled Pranjal Kumar v. Dr Suresh Kumar Medical Director Health & Amp; Family Welfare.
We find that by the Impugned Orders, the learned Tribunal has merely directed the petitioner to comply with its ad-interim order dated 19.01.2023 passed in the above O.A., and thereafter adjourned the matter at the request of the petitioner itself to comply with the said interim direction.
We also find that the learned Tribunal has also placed reliance on the Letter dated 12.04.2023 of the Nodal Officer (DGEHS), Lok Nayak Hospital, which certifies that the respondents were working and coming regularly for duty till at least the date of the said Letter, that is, 12.04.2023.
The learned counsel for the respondents has further placed reliance on the duty roster for the month of April 2023 issued by the Lok Nayak Hospital, which contains the names of the respondents and the duty assigned to them.
We, therefore, find no merit in the present petition. The same along with the pending application is dismissed.
The petitioner shall pay costs of Rs.7,500/- to each of the respondents herein within a period of four weeks from today.
We, however, make it clear that the learned Tribunal shall decide on the Contempt Petition as also the O.A. remaining uninfluenced by our Order.
