This is a review petition filed by the petitioner in O.P. (C). No.2258/2021.
In this case, as per judgment dated 14.01.2022, this Court directed early disposal of I.A.No.4168/2019 in O.S.No.692/2019 pending before the Principal Munsiff’s Court, Kollam.
It is submitted by the learned counsel for the petitioner that the learned Munsiff disposed of I.A.No.4168/2019, in obedience to the directions issued by this Court. He would submit further that in the original petition, there was prayer to dispose of the Suit itself. In fact, while passing the judgment, the said prayer was virtually negatived by this Court, considering the fact that the Suit is of the year 2019 and taking note of pendency of oldest cases. Therefore, the said finding is not a subject matter of review, as the same could not be held as an error apparent on the face of the records.
In view of the matter, this review petition stands dismissed with liberty to the original petitioner to approach this Court by filing a fresh original petition, seeking early disposal of the Suit for sustainable reasons.
