Judgment
Manoj Kumar Tiwari, J
Petitioner was posted as Chief Veterinary Officer at Dehradun. Now, he has been attached in the Directorate of Animal Husbandry, Dehradun vide order dated 19.08.2021. This, according to the petitioner, is impermissible, as according to him, attachment is made when disciplinary inquiry is initiated against an Officer or he is put under suspension.
We are not expressing any opinion on this submission of the petitioner.
Mr. Rakesh Thapliyal, learned Senior Counsel appearing for the petitioner confines his prayer and submits that petitioner may be permitted to make a fresh representation to the Competent Authority, who shall take decision thereupon within some stipulated time.
Accordingly, the writ petition is disposed of with liberty to petitioner to approach the Competent Authority/Director, Animal Husbandry, Dehradun by making fresh representation. If such representation is made within three days from today, Director shall take decision thereupon, in accordance with law, within a period of two weeks from the date of production of such representation along with certified copy of this order.
Let certified copy of this order be supplied to the petitioner today itself.
