Judgment

Notice. Mr. Ajay Vaidya, learned Senior Additional Advocate General appears and waives service of notice on behalf of the respondents
The instant petition has been filed for the grant of following substantive reliefs:-
“i) That the respondents may kindly be directed to consider the case of the petitioner as well as his wife for their transfer to Civil Hospital, Fatehpur against vacant post or to any nearby vacant station in the interest of justice.
ii) That the respondent may kindly be directed to decide the representation of the petitioner Annexure P-2 in a time bound manner.”
Records reveal that the petitioner in February, 2022 was diagnosed as a case of Carcinoma of Buccal Mucosa and underwent a surgery and on account of such surgery, he needs a regular attendant to look-after him. The petitioner has preferred a representation for his transfer, which is required to be considered positively by the respondents, keeping in view, the peculiar facts and circumstances of this case, more particularly, the ailment of the petitioner.
Accordingly, we deem it proper to dispose of this petition by directing the respondents to consider the representation made by the petitioner dated 12.10.2022 (Annexure P- 2) and take a decision sympathetically, within a period of three weeks from today. Pending applications, if any, also stand disposed of.
