Judgment
Rajiv Narain Raina, J. (Oral)—Dr. Sahib Singh & Sons was an historic chemists'' shop in one corner of Sector 17, Chandigarh where people flocked to buy medicine and mothers for inoculating their children. The establishment had shifted in the 50''s from ''Simla'' as it was then spelled, in the nascent years of Chandigarh coming up. The establishment perished many years ago and with the shutters down the Name Board disappeared. But still the area is famously known as ''Dr Sahib Singh Light Point'' and ''Dr Sahib Singh Parking Lot''. Dr Sahib Singh passed away long ago.
The 2nd Respondent worked as a Salesman in the famous shop from 19.04.1959 to 23.06.1994. His services were terminated. He said it was illegal. He went to Labour Court, Chandigarh against the illegal termination and succeeded. He was awarded reinstatement with 60% back wages.
The petitioner filed this writ petition in 1999 assailing the Award which has come up today for final hearing. None appears for it. Mr. Talwar is for the workman. The record reveals that the salesman died on 03.09.2001 at an advanced age. His LRs are on record claiming monetary benefits. The business is shut. Execution of Award, if upheld, would be near impossible. The liability of Dr. Sahib Singh & Sons by the impugned Award cannot be fastened personally on the survivors of Dr. Sahib Singh. Therefore, I believe no useful purpose would be served in deciding the petition on merits. We pray that the souls of Dr. Sahib Singh and Shiv Dev Singh rest may in peace.
