Judgment
M. Jaichandren, J.—Heard Mr. C.K.M. Appaji, the learned Counsel appearing on behalf of the Petitioner, as well as Mr. K.M.
Vijayakumar, the learned Special Government Pleader appearing on behalf of the Respondents.
The Petitioner, by his representation, dated 20.04.2010, had requested the first Respondent to change the Investigating Officer, who is
investigating the case registered against the Petitioner, in crime No. 74 of 2009, u/s 294(b), 307 and 506(ii) of the Indian Penal Code.
In view of the averments made in the affidavit filed in support of this petition and in view of the submissions made by the learned Special
Government Pleader appearing on behalf of the Respondents, this Court does not find sufficient cause or reason to grant the relief, as prayed for
by the Petitioner, in the present writ petition. The Petitioner has not been in a position to show proper reasons for the transfer of the Investigating
Officer, as prayed for in the writ petition. Further, it is for the Petitioner to approach the appropriate forum to seek his relief, as per the relevant
provisions of the law, if he is not satisfied with the investigation by the second Respondent. Further, the Petitioner has not raised any issue in the
writ petition stating that the second Respondent is conducting the investigation in a mala fide manner. As such, the writ petition is devoid of merits
and therefore, it is liable to be dismissed. Hence, the writ petition is dismissed. No costs.
