Vide order dated 27.11.2020, learned cousnel for the parties were directed to place on record copy of CWP No.20224 of 2020 as well as order
passed therein. Copy of the order dated 27.11.2020, passed in said petition has been perused vide which the petition has been disposed of by granting
liberty to the petitioner to approach Central Administrative Tribunal (hereinafter to be referred as 'CAT') for mitigation of her grievance and to assail
the validity of the scheme.
Apparently, the petitioner's remedy lies before the Central Administrative Tribunal and therefore, in view of the decision of Hon'ble Supreme Court in
L. Chander Kumar vs. Union of India and others, 1997(3) SCC 26,1 specifically the law laid down in paragraph 93 therein, the petition filed by the
petitioner is disposed of granting liberty to the petitioner to approach the CAT for redressal of her grievances and assailing the validity of the scheme.
Accordingly, the present petition is disposed of with the liberty aforesaid.
Since main case has been disposed of, all the pending applications also stand disposed of accordingly.
