Judgment
Rajiv Sharma, J.—Himachal Pradesh University on behalf of State Government issued advertisement whereby applications were invited from the eligible and qualified candidates for D.M. (Cardiology) and M.Ch. Cardiothoracic Vascular Surgery (C.T.V.S.) super-specialty courses for the academic session 2011-2014. The basis of admission for the super-specialty course is by way of All India Entrance Test to be held on 14.8.2011. The last date of receipt of applications was 4.8.2011. It is specifically mentioned at Sr. No. "Eligibility" that there shall not be any reservation of seats for any category or group.
Case of the Petitioner, in a nutshell, is that quota ought to have been provided to in-service candidates in D.M./M.Ch. courses. Petitioner has not made any representation to the Principal Secretary (Health) to the Government of H.P. for the redressal of his grievance. The Court, without going into the gamut of the entire matter, deems it proper to permit the Petitioner to make a representation to the Principal Secretary (Health) for the redressal of his grievance within a period of two days from today. Thereafter, the Principal Secretary (Health) shall decide the same in accordance with law on or before 12.8.2011 by passing a speaking order.
In view of above, the present petition is disposed of, so also the pending application(s), if any. No. costs. A copy of this order, duly authenticated by the Court Master be supplied to the Petitioner.
