Judgment

The present writ petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of certiorari for quashing/setting aside the order issued vide endst. Dated 26.10.2023 (P-46), whereby the resignation of the petitioner, post facto w.e.f. 17.03.2020 has been accepted despite the act that the petitioner formally submitted representation for withdrawal of her request dated 19.04.2022 (P-33).
Learned counsel for the petitioner submits that the prayers contained at Sr. Nos. A, B and C are not being pressed and the petitioner confines the present petition to the relief sought at Sr. No. D qua release of the bonds/sureties for Rs.15.00 lac dated 08.10.2013 (P-8) along with two sureties bonds and Sr. No. E qua release of annual increments and other fiscal benefits such as ACP along with refixation of pay, the arrears since her appointment/joining w.e.f. 23.04.2013 approved under Rule 8.121 of the Punjab Civil Services Rules, Volume-I, Part-I.
Learned State counsel, on instructions, fairly submits that the petitioner has already resigned from service. He further undertakes that the surety bond(s) furnished by the petitioner to the extent of Rs.15,00,000/-, along with the two surety bonds, shall be released within a period of four weeks.
As regards the claim raised in the prayer at Sr. No.E qua release of annual increments and other fiscal benefits such as ACP along with refixation of pay, the arrears since her appointment/joining w.e.f. 23.04.2013 approved under Rule 8.121 of the Punjab Civil Services Rules, Volume-I, Part-I, the petitioner shall be at liberty to submit a detailed representation before the competent authority along with all supporting documents, claiming the amount, if any, legally admissible to him, including other service/pensionary benefits.
The competent authority shall consider and decide the said representation, in accordance with law and the applicable rules, by passing a speaking order within a period of four weeks from the date of receipt of such representation and shall release the amount, if found admissible, within a reasonable period thereafter.
In view of the aforesaid statement/undertaking made by learned State counsel, the present petition is disposed of. The petitioner shall, however, be at liberty to avail of his remedies in accordance with law in case any grievance survives after the decision of his representation.
Ordered accordingly.
Pending miscellaneous applications, if any, also stand disposed of.
