Judgment
Ahanthem Bimol Singh, J
Mr. H.S. Paonam, learned senior counsel assisted by Mr. S. Gunabanta, learned counsel appeared for the petitioner, Mr. A. Vashum, learned GA appeared for the official respondents and Mr. N. Ibotombi, learned senior counsel assisted by Mr. A. Rommel, learned counsel entered appearance on behalf of respondent No.3.
As directed earlier by this court, the learned Government Advocate produced the relevant Government file and placed it before this court.
Registry is directed to obtain a Xerox copy of the said file produced by the learned Government Advocate and to return the original file to the learned Government Advocate so as to enable him to file counter affidavit.
Both the learned Government Advocate as well as the counsel for the private respondent seeks two weeks’ time for filing their respective counter affidavit.
Prayer is allowed.
As prayed for, list this case again on 12-04-2023. In the meantime, the respondents are directed to file their counter affidavit without fail. It is made clear that if the respondents failed to file their counter affidavit, the prayer for passing interim order will be considered.
