Judgment
Vipin Sanghi, CJ
The learned Standing Counsel for the respondents has taken instructions. He, firstly, states that the Transfer Committee shall dwell upon the petitioner’s medical condition, as emerging from the medical certificates produced by her, and only thereafter, take a considered decision with regard to her transfer. He further submits that insofar as the release of the petitioner’s salary is concerned, for the month of April, 2022, the same stands released. For the subsequent months, it would be essential for the petitioner to make an application for leave on medical certificate, in terms of Rule 81(b)(ii) of the Uttar Pradesh Fundamental Rules, 1935, which are applicable to the State of Uttarakhand.
The learned counsel for the petitioner states that the petitioner shall make the said application.
Once the said application is made, the same shall be actioned by the respondent nos. 2 and 3 without any delay.
The Writ Petition stands disposed of in the aforesaid terms.
In sequel thereto, all pending applications also stand disposed of.
