Judgment
JUDGMENT: (per Manoj Kumar Gupta, C.J.)
The present writ petition has been filed by the petitioner being aggrieved by a notice dated 29.05.2026 issued by the University mentioning the names of faculty members and other employees who would retire during the academic year 2026-27, i.e. July 2026 to June 2027, and wherein the name of the petitioner, who is Professor, Maize Breeder, Department of Genetics and Plant Breeding, College of Agriculture, Govind Ballabh Pant Agriculture and Technology University, Pantnagar is shown at Serial Number 1. His age of retirement has been shown as 60 years, and according to which, he would retire on 31.08.2026.
Learned Counsel for the petitioner has placed reliance upon an order dated 27.06.2024, passed by a Coordinate Bench in WPSB No. 344 of 2024, in respect of a Professor of Agronomy in Krishi Vigyan Kendra, Jeolikote, Nainital, which is an Extension Center of G.B. Pant University of Agriculture and Technology. The said writ petition was disposed of granting liberty to the petitioner to make representation to the University. The submission of the petitioner in the said case was that his claim was covered by the judgment in WPSB No.333 of 2023, Dr. Anuradha Dutta vs. State of U.P. and Others, and other connected matters, decided by a common judgment dated 21.05.2024.
Learned Counsel for the University as well as Learned Standing Counsel have no objection, in case, the present writ petition is also decided in same terms.
Accordingly, the writ petition is disposed of with liberty to the petitioner to make a fresh representation to the Competent Authority of the University. It is further provided that, in case, any such representation is made within 48 hours, the Competent Authority shall take decision thereupon within two weeks from the date of receipt of the representation.
