This writ petition is filed challenging Ext.P11 proceedings of the Selection Committee for appointment to the post of Guest Lecturer in Sanskrit (Sahitya) and seeking directions to conduct a fresh selection for appointment as Guest Lecturer. The learned counsel for the petitioner submits that the ranked list prepared pursuant to Ext.P4 notification was brought into force only on 25.08.2022 and therefore the same should be deemed to have been in force till 25.08.2023. It is submitted that, in the meanwhile, Ext.P15 notification has been issued for appointment of Guest Lecturer and the same is liable to be set aside by this Court.
The learned counsel appearing for the 2nd respondent as well as the learned counsel appearing for respondents 3 and 4 submit that Ext.P4 would make it clear that the notification was with regard to appointment of Guest Lecturer for the academic year 2022-2023 and since the academic year has already ended, this writ petition has become infructuous. It is further contended that Ext.P15 is a notification issued for appointment of Guest Lecturer for the academic year 2023-2024 and that the petitioner has not submitted any application pursuant thereto and therefore, no orders can be granted.
Having considered the contentions advanced and in view of the fact that Ext.P4 would reveal that the appointment of Guest Lecturer as per the notification referred to in Ext.P4 was specifically for the academic year 2022-2023, the contention of the petitioner that the ranked list is still in force cannot be accepted. In the above view of the matter, there is no illegality in issuance of a notification for appointment of Guest Lecturer for the academic year 2023-2024.
The learned counsel for the petitioner submits that the petitioner has not submitted an application pursuant to Ext.P15 only due to the pendency of this writ petition.
In the result, this writ petition is dismissed. However, in case the petitioner submits an application pursuant to Ext.P15 along with a representation explaining the delay in submitting the same before the 3rd respondent immediately, that is, on tomorrow itself, the said request of the petitioner for consideration of her claim in terms of Ext.P15 shall be examined by the 3rd respondent.
This writ petition is ordered accordingly.
