D.R. Mehla vs The Additional Registrar, Co-operative Societies

The petitioner by way of this writ petition has challenged the

order of reversion dated 05.10.1999 whereby he was reverted

from the post of Project Officer on which he had been promoted on adhoc basis by earlier order dated 24/25.10.1997.

It has been submitted that revision petition was preferred

which has also been rejected on 21.10.1999 on the ground that

the Board of Management had not sanctioned regular promotion.

In reply to the writ petition respondents who stated that the

petitioner does not possess the requisite educational qualifications

for the purpose of promotion to the post of Project Officer and no

right is created in his favour on adhoc basis.

Having heard the counsel for the parties. This Court finds

that the petitioner''s promotion was purely on adhoc basis and the

Board of Management ultimately did not sanction the post for

promotion on regular basis. Moreover, as has come in reply, the

petitioner does not possess the qualifications required for the post

of Project Officer as he did not possess the degree of Bachelor of

Veterinary Science or Bachelor of Animal Husbandry or Bachelor of

Dairy Science, whereas the petitioner possessed the qualification

of Bachelor of Science (Agriculture) which cannot be treated as

equivalent qualification.

Accordingly, the reversion order dated 05.10.1999 cannot be

said to be unjustified. This writ petition fails and is hereby

dismissed.
