Hon''ble Prafulla C. Pant, J.—Heard.
By means of this petition, moved u/s 482 Cr.P.C., the petitioner has sought quashing proceedings ofAkbar Ali Vs. Amarjeet Singh and others Criminal Complaint Case No. 205 of 2011, relating to offence punishable u/s 420 I.P.C., Police Station-Rudrapur, District Udham Singh Nagar, pending in the court of Judicial Magistrate, Rudrapur.
Learned counsel for the parties state that parties to the litigation have entered into the compromise, and compounding application No. 1369 of 2011, has been filed, supported by the joint affidavit of the parties.
Complainant Akbar Ali present in person, identified by his counsel verified that he does not want to prosecute the petitioner.
In view of the principle of law laid down in Nikhil Merchant Vs. Central Bureau of Investigation and Another, , this Court is of the view that petition u/s 482 Cr.P.C., deserves to be allowed, as complainant says that he has been paid the amount relating to loss suffered by him.
Therefore, the petition u/s 482 Cr.P.C., is allowed. The proceedings of Criminal Complaint Case No. 205 of 2011, Akbar Ali Vs. Amarjeet Singh and others, relating to offence punishable u/s 420 I.P.C., Police Station-Rudrapur, District Udham Singh Nagar, pending in the court of Judicial Magistrate, Rudrapur, are hereby quashed, so far as the same relate to the accused Dr. Manmohan Singh. (Compounding Application No. 1369 of 2011, stands disposed of).
