Judgment
Since the common questions of law and fact are involved in all these petitions, hence these are being taken up together and decided by this common judgment.
Petitioners are working on contractual basis. However, they have been denied the maternity leave by the employer. The question raised in these petitions is no more res integra in view of the judgment rendered by one of us (Sudhanshu Dhulia, J.) in Writ Petition (S/S) No.826 of 2012, decided on 8.7.2013, which was affirmed by the Division Bench of this Court on 15th December, 2016 in Writ Petition (S/B) No.99 of 2015.
Accordingly, the present writ petitions are also allowed.
In WPSB No.188 of 2016, the respondents are directed to grant the maternity leave to petitioner with full pay from 10.3.2015 to 29.7.2015.
In WPSB No.105 of 2014, the rejection order/ letter dated 21.3.2014 (Annexure No.1) is quashed and set aside. The respondents are directed to grant the maternity leave to petitioner with full pay from 7th April, 2014 to 7th October, 2014.
In WPSB No.138 of 2014, the rejection order/ letter dated 24.6.2013 (Annexure No.1) is quashed and set aside. The respondents are directed to grant the maternity leave to petitioner with full pay from 8.9.2013 to 8.3.2014.
In WPSB No.78 of 2015, the impugned order dated 25.2.2015 (Annexure No.7) is quashed and set aside. The respondents are directed to grant the maternity leave to petitioner with full pay from 7th January, 2015 to 7th June, 2015.
In WPSB No.178 of 2016, the respondents are directed to grant the maternity leave to petitioner along with full pay from 30.6.2015 to 27.12.2015.
In WPSB No.193 of 2016, the respondents are directed to grant the maternity leave to petitioner with full pay from 8.2.2016 to 7.8.2016.
All pending applications also stand disposed of.
