Through this application, the applicant is seeking refund of Court fee deposited while filing application under Section 7 of IBC, 2016. This is a case of Home Buyer and the application filed under Section 7 became non maintainable in view of the subsequent amendment in Section 7 read with Section 21(6A) of IBC, 2016.

In these circumstances, we are exercising our jurisdiction under Rule 11 of NCLT, Rules, 2016 and direct the registry to refund the Court fee to the applicant within 7 days from today.

This application, accordingly, stands allowed and disposed of in terms indicated above.
