This is an application filed by the petitioner seeking to rely upon certain additional documents for the purpose of the writ petition. The learned counsel for the petitioner submits that these documents would be relevant for determining the issues raised by the petitioner in the writ petition.
Mr. B.C. Tamang, learned counsel appearing for the respondent-University vehemently objects to the same on the ground that this application is grossly belated and further that the petitioner has not been able to show in whose custody these documents were with. It is his submission that therefore the application ought not to be entertained.
The application seeks to place on record six documents: (i) A copy of the EC meeting dated 31.10.2015 (ii) A copy of the notification dated 06.03.2019 by the respondent-University (iii) A copy of the order of JNU dated 18.09.2017 (iv) A copy of the office order of the Sikkim University dated 24.10.2017 (v) A copy of the profile of Ms. Dipmala Roka, Assistant Professor, Department of International Relations, Sikkim University and (vi) A copy of the EC meeting dated 01.12.2017 and 08.02.2019. All these documents except one have been issued by the respondent-University. With regard to the profile of Ms. Dipmala Roka, Assistant Professor, Department of International Relations, Sikkim University, this Court is of the view that relevant pleadings are not there in the writ petition. The rest of the documents are accepted. Their relevance would be considered at the time of the final disposal of the writ petition. The application is disposed of accordingly.
