We have heard learned counsel for the parties at some length.

The grievance raised by the petitioner in the present writ petition is that the petitioner and other teaching and non-teaching staff of KLDAV PG College, Roorkee, affiliated to Sri Dev Suman Uttarakhand University, are not being paid their salaries and allowances since March 2022. The reason for the said non-payment is said to be non-renewal of registration of the respondent no.4-Society. The non-renewal of registration of the said society appears to be on account of inter-se dispute between the members of the society.

Since the aforesaid college is imparting higher education to about 1500 students and there are 36 teaching and non-teaching staff-as informed by learned counsel for the petitioner, who are rendering their services, the non-payment of the salaries and allowances to the teaching and non-teaching staff of the said college would certainly impact the functioning of the institution and put studies and future prospects of the students in jeopardy, and the same would be contrary to the public interest. The said college is Government Aided College and the complete salary and allowances of the teaching and non-teaching staff is provided for by the State.

In these circumstances, we direct the State of Uttarakhand through the respondent no.3 i.e. Chief Education Officer, Roshanabad, District Haridwar, Uttarakhand to ensure that the salaries and allowances of all the teaching and non-teaching staff of the said college are directly disbursed into the bank accounts of the teaching and non-teaching staff along with arrears. The arrears shall be paid within the next one month. However, the current salaries and allowances should be disbursed without any delay.

We are informed that the Deputy Registrar Societies and Firms has fixed the meeting with all the office bearers/members of the Society on 25.07.2022. The Deputy Registrar may pass an appropriate order after hearing all the parties concerned, which shall be communicated to the parties.

In view of the above, the writ petition stands disposed of.
