Judgment
B.C. Kandpal, J.—By means of this petition, under Article 226 of the Constitution of India, the petitioner has prayed for issuing a writ in the nature of mandamus, commanding the respondents to disclose the pendency of any criminal matter against her, as well as the writ of certiorari to quash the F.I.R., if any, lodged against her.
The facts revealed from the petition are that the petitioner is at present posted as Deputy Director, Central Building Research Institute, Roorkee and lives at Roorkee. Her father had filed a suit for permanent injunction against Sanjay Kumar Agarwal, Anil Kumar Singhal and Hanslata Singhal, which is pending before Civil Judge (J.D.) Roorkee. Due to civil suit, the above persons started to have personal vengeance against the petitioner and also started to exert the pressure to withdraw the above suit, as her father died during the pendency of the suit. Further allegations of the petitioner are that on 16.6.2010 the above persons attacked upon her and her sister. The petitioner handed over written complaint to S.H.O. Kotwali Roorkee, but he did not lodge the report. The accused persons in connivance of police are mounting pressure upon petitioner to withdraw the complaint, otherwise to face dire consequences. Police also visited her house several times and tried to arrest them. She also alleged that police in the garb of false complainant, is harassing the petitioner and her family members for no fault of her own and as such the arrest of the petitioner is required to be stayed during the investigation. Hence this petition.
Heard Sri Nagesh Agarwal, learned Counsel for the petitioner and Sri Nandan Arya, learned A.G.A. on behalf of State and perused the record.
Having considered the submissions raised by learned Counsel for the parties, and perusing the entire material available on record, we do not find any ground to issue a writ either in the nature of mandamus or certiorari. The petition lacks merit and is liable to be dismissed.
The petition is dismissed in limine.
The CLMA also stands disposed of.
