Judgment
Kurian Joseph, C.J.—The writ petition has been filed with the following prayers:
(i) That a writ of mandamus/certiorari may kindly be issued to the Respondents.
(ii) That order, dated 4th August, 2008 contained in Annexure P-9 may kindly be set aside and quashed.
(iii) That the Respondents may kindly be directed to provide seniority and financial benefits to the present Petitioner for the post services which he has rendered in 95% aided College i.e. with effect from 5th August, 1996 to 4th August, 1999.
According to the Petitioner, the issue is squarely covered by the decision of this Court rendered in CWP(T) No. 3125 of 208 (OA 689/96), Satya Pal Sood v. The Commissioner-cum-Secretary (Education) in CWP(T) No. 3125 of 208 (OA 689/96) to the Government of H.P., Shimla.
There will be a direction to the first Respondent to look into the matter in the light of the judgment referred to above and in case the Petitioner is similarly situated as the Petitioner in the judgment, referred to above, a similar treatment shall be extended to the Petitioner herein also. Needful in this behalf shall be done within 4 months from the date of production of the copy of this judgment alongwith the copy of the writ petition by the Petitioner.
The writ petition is disposed of, so also the pending applications.
