Judgment
The impugned order only requires the Petitioner to pay back to the Government a sum of Rs.39,560/-. While issuing notice in the present petition
way back on 7th December 2004, this Court stayed the operation of the said order. Therefore, for nearly twenty years now that order has remained
stayed. No counter affidavit has been filed till date.
With the Petitioner already having superannuated way back in 1999, and he being almost 81 years old today, the Court sees no reason why it should
examine the merits of the case to decide the questions that may arise in the present petition.
Learned counsel for the Petitioner states that the Petitioner will, without prejudice to his rights and contentions, pay the aforementioned sum of
Rs.39,560/- to the Government within four weeks from today.
Recording the above assurance, the writ petition is disposed of. No further action will be taken against the Petitioner unless he does not adhere to
the above assurance.
An urgent certified copy of this order be issued as per rules.
