Learned counsel for the petitioner has shown the order passed by a Jaipur Bench of this Hon’ble Court in Dr. Diksha Kumari Chittara Vs.The State of Rajasthan & Ors. (S.B. Civil Writ Petition No.17592/2022) on 09.01.2023, which reads as follows:
“Learned counsel for the petitioner submits that the issue involved in the present writ petition is sub-judice before the Division Bench and the Division Bench, in Special Appeal (Writ) No.1311/2022 tilted as The State of Rajasthan Vs. Dr. Nishant Gopaal & other connected appeals, has passed an order on 09.12.2022, whereby direction has been given to the candidates to give an undertaking on affidavit before this Court for return of documents and the case of the petitioner is also required to be considered as per direction of the Division Bench.
Learned counsel appearing for the respondents submits that the necessary undertaking or affidavit is required to be filed by the petitioner and if he does the same, the Authorities will comply with the order passed by the Division Bench.
Learned counsel for the petitioner seeks one week’s time to file the requisite undertaking as per direction of the Division Bench.
List after ten days. ”
The afore-quoted order shall also operate in the present case also.
List the matter on 01.11.2023 alongwith S.B. Civil Writ Petition No. 15069/2023.
