Judgment
Dinesh Mehta, J
Mr. S.P. Sharma, learned counsel for the petitioners submits that following three issues mentioned in the prayer clause No.3 be determined:
(i) whether the petitioners gave consent to decide the matters, without grant of benefit of arrears from the date of decision of the Jagjit Singh (supra).
(ii) whether the petitioners gave consent for not claiming benefit of attached allowances of the minimum of pay sale, including dearness allowances
and accepted the minimum of pay scale of the post, without any attached allowances and;
(iii) whether order dated 20.01.2020 passed in this writ petition No.16913/2020 and other connected matters decided together, was passed on the
consent of petitioners and their counsel, to claim benefit of minimum of pay scale from the date of filing of writ petition, without any other benefits or
allowances on basic pay?â€
After hearing Mr. Sharma, learned counsel for the petitioners and upon perusal of the order dated 20.01.2020, this Court is of the view that the
order under consideration is very clear. This Court has adjudicated petitioners’ right, on the basis of the rival submissions and not on consent.
In view of the aforesaid, issues raised by the petitioners does not require any clarification.
The misc. application is, therefore, dismissed.
