Judgment
Petitioner challenges order dated 15.06.2017, by which the petitioner stands transferred from Directorate, Medical, Health and Family Welfare, Uttarakhand to District Chamoli as Additional Chief Medical Officer, Chamoli. Petitioner has already addressed Annexure-8 representation dated 19.06.2017.
We heard Mr. Ganesh Kandpal, learned counsel for the petitioner and Mr. Paresh Tripathi, learned Chief Standing Counsel for the State of Uttarakhand / respondents.
We are of the view that the writ petition is to be disposed of by directing respondent no. 2 to consider and take a decision on Annexure-8 representation in accordance with law, which will include the transfer policy also, within a period of two weeks. Accordingly, reserving the right of the petitioner to approach this Court, if need arises, against the impugned order and leaving open all the contentions of the petitioner, we dispose of the writ petition by directing the second respondent to consider and take a decision on Annexure-8 representation of the petitioner in accordance with law, which will include the transfer policy also, within a period of two weeks from the date of production of a certified copy of this judgment.
Let certified copy of this order be issued today itself.
