By means of this petition, moved u/s 482 of Code of Criminal Procedure,1973, the Petitioners have sought quashing of the proceedings of Criminal Case No. 2387 of 2002, (new No. 1597 of 2010) State v. Bhupal Singh and Ors. relating to offence punishable u/s 498A I.P.C, and one punishable u/s 3/4 of Dowry Prohibition Act, 1961, pending in the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar.

Earlier, Criminal Misc. Application (C-482) No. 103 of 2004 was filed before this Court which was disposed of vide order dated 13.04.2010. After disposal of said application, during trial, now parties to matrimony have entered into compromise.

Today, complainant Raghubir Singh Gahlot (Respondent No. 2) and his daughter Kiran (wife of Sanjay Singh, Petitioner No. 3) are present in the court identified by their counsel, and they verified the fact that the parties to matrimony have entered into compromise, and complainant Raghubir Singh Gahlot and Smt. Kiran do not want to prosecute the Petitioners. A compounding application has been filed in court today alongwith the affidavits filed by Sanjay Singh and Raghubir Singh Gahlot.

In the above circumstances, in view of principle of law laid down in B.S. Joshi and Others Vs. State of Haryana and Another, , this petition deserves to be allowed.

Accordingly, the petition u/s 482 of Code of Criminal Procedure, is allowed. The proceedings of Criminal Case No. 2387 of 2002, (new No. 1597 of 2010) State v. Dr. Bhupal Singh and Ors. relating to offence punishable u/s 498A I.P.C, and one punishable u/s 3/4 of Dowry Prohibition Act, 1961, pending in the court of Judicial Magistrate, Kashipur, District Udham Singh Nagar, are hereby quashed, as against the Petitioners Dr. Bhupal Singh, Smt Urmila and Sanjay Singh. (Compounding Application also stands disposed of )
