In the present writ petition, the petitioner is praying for issuance of a writ in the nature of certiorari for quashing the office order dated 17.10.2018 (Annexure P-13) whereby the respondents had cancelled the earlier passed orders dated 07.03.2018 and 16.04.2018 (Annexure P-12 colly.) and the claim of the petitioner for pay protection was rejected.

One of the grounds raised in the present petition for challenging the order dated 17.10.2018 (Annexure P-13) is that no opportunity of hearing was granted to the petitioner before the abovesaid order was passed.

Learned counsel for respondents No.4 and 5 fairly submits that a fresh order will be passed in regard to entitlement of pay protection of the petitioner after affording an opportunity of hearing to him.

In view of the statement given by learned counsel for respondents No.4 and 5, learned counsel for the petitioner submits that he does not want to press the present writ petition, however, liberty may be granted to the petitioner for revival of the writ petition, if no opportunity of hearing is given to him before passing a fresh order.

In view of above, the present writ petition is disposed of as not pressed with liberty as prayed for. The respondents are directed to pass a fresh order in regard to grant of pay protection to the petitioner, after affording him an opportunity of hearing, in accordance with law, within a period of two months from the date of receipt of certified copy of this order.

Pending application(s), if any, shall also stand disposed of.
