Petitioner has filed this petition making an innocuous prayer that dispute between the petitioner and respondent No.2 is pending since 2017 before the learned Deputy Registrar, Cooperative Societies, Jabalpur but Deputy Registrar is not deciding the said dispute.
Shri Lalmani Tripathi is not in a position to give number of the case pending before the Deputy Registrar ,Cooperative Societies. It is also evident that on 19.02.2014 a Coordinate Bench had passed orders in Second Appeal No.1335/2005 directing the appellant therein to raise his grievance under Section 64 of the M.P. Cooperative Societies Act and had held that suit is not maintainable.
Shri Sourabh Soni, learned Panel Lawyer for the State objects to entertaining this petition and submits that since no registration number of the dispute is given, no innocuous relief can be granted.
Shri Tripathi is not in a position to give number of dispute as was preferred by him in the year 2017. Therefore, no indulgence is required in the matter and in absence of any pendency of the dispute no direction can be given to the Deputy Registrar, Cooperative Societies, Jabalpur to decide the same.
Accordingly, petition fails and is hereby dismissed.
