Dr. Ashutosh Kumar Dubey vs State of M.P. and others

It is submitted by Shri Jaideep Singh, learned Counsel for State that in the petition itself, petitioner has stated that he is working in RCH programme, but has not filed any document in respect of appointment of petitioner in RCH. Shri Aditya Sanghi, learned Counsel for petitioner submits that except the appointment order Annexure P-4, no other appointment order has been issued to the petitioner. It is submitted by him that after the appointment order Annexure P-4 petitioner is still working as Medical Officer on contract and is entitled for Post Graduation course.

The aforesaid position is also disputed by Shri Vipin Yadav, learned Counsel for interveners.

To clarify the position, we direct Shri Jaideep Singh to file an affidavit of some competent officer of the State showing the status of the petitioner Dr. Ashutosh Kumar Dubey and other petitioners, who have filed the petitions and their cases are linked with this petition, about their status. The affidavit should clearly reveal whether the petitioners are working as Medical Officers, appointed on contract basis or they are working in RCH programme. The affidavit should further disclose whether the appointing authority of petitioner at present is the State Government or the local committee at the district level. The aforesaid be filed by tomorrow.
