Judgment
Notice of motion.
On our asking, Mr. Gautam Pathania, Advocate accepts notice on behalf of respondent No.1-Panjab University; Mr. Vivek Singla, Advocate accepts notice on behalf of respondent No.2-Union of India and Mr. Rajesh Bhardwaj, Addl. AG Punjab accepts notice on behalf of State of Punjab, in both the cases.
Heard learned counsel for the parties on the question of interim relief as prayed for by the appellant(s).
Having regard to all the attending circumstances including:-
(i) that the academic sessions are going on and in the event of bulk retirement under the orders of learned Single Judge most of the teaching faculties will face acute shortage of teachers;
(ii) the University is already deficient in manpower in the teaching faculty;
(iii) the University since the year 2011 is getting almost entire funding from the Union of India through the Ministry of Human Resource and Development;
We direct the University to allow the appellants and other similarly placed teachers who were continuing in service till a day before the pronouncement of judgment of learned Single Judge to continue in service on reemployment basis till they attain the age of 65 years, without prejudice to their right to monetary claims in the event of acceptance of these appeals.
We further direct that the appellants or other similarly-placed teachers shall be allowed to retain the residential accommodation(s) allotted to them by the University on the same terms and conditions.
Post again on 13.09.2016.
Photocopy of this order be placed on the record of other connected case.
