Judgment
Heard learned counsel for the parties.
The petitioner seeks a writ of mandamus commanding the respondents to immediately grant the 1st financial upgradation under the MACP Scheme to the petitioner w.e.f. 26.08.2026 and also pay the accumulated arrears along with interest @ 9% per annum.
The petitioner is holding the post of Medical Officer (Ayurvedic) and is presently posted at State Ayurvedic Dispensary, Banskatal, District Tehri Garhwal. He is stated to have filed various representations before the respondents for grant of financial upgradation but when his claim has not been considered, the present writ petition has been filed.
Learned State Counsel, on the basis of the instructions received from the Department, states that the claim of the petitioner is under consideration.
Accordingly, the writ petition is disposed of with direction to the competent authority to consider and decide the claim of the petitioner for financial upgradation within a period of twelve weeks from the date of communication of the instant order along with a fresh representation.
Pending application, if any, also stands disposed of.
