This matter is taken up through hybrid arrangement.
Heard.
Learned counsel for the petitioners submits that the petitioners have not taken any House Rent Allowance during the period from the month June, 2007 till the date of their vacation of quarters as they were charged with penal house rent.
Learned counsel for the State is directed to take instructions regarding non-receipt of House Rent Allowance by the petitioners during the period from the month June, 2007 till the date of their vacation of quarters and accordingly, make a fresh calculation with due apportionment of HRA during the said period. It is further directed to recalculate the penal interest by giving weightage to the fact of non-receipt of the House Rent Allowance.
List this matter on 17th of October, 2022.
Issue urgent certified copy of the order in course of the day as per Rules.
A free copy of the order be supplied to the learned counsel for the State for necessary compliance.
