Judgment
S. Manikumar, J.—The present Writ Petition has been filed for a Mandamus, directing the Respondent to grant staff list approval and consequently, include the Petitioner''s institute name in the list of institutes allowed to participate in the single window counseling for the academic year 2011-2012.
When the learned Counsel appearing for the Petitioner was confronted with the question whether there is any affiliation of the institution, he replied that there is No. affiliation and the matter is still pending before the educational authorities for consideration. It is well settled by a judgment of a Division Bench of this Court that without any affiliation, No. educational institution has a legal or statutory right to admit any students. Learned Counsel for the Petitioner seeks permission to withdraw the writ petition.
In view of the above, permission is granted to withdraw the writ petition. However, No. leave is granted to file a fresh writ petition on the same cause of action. Accordingly, the writ petition is dismissed as withdrawn. No. costs. Consequently, the connected Miscellaneous Petition is closed.
