DIWAN SINGH vs NEW INDIA ASSURANCE CO.

IN a complaint filed by the complainant mentioned above it has been stated that the Truck No. 5765 JKR was insured with the respondent Company. The Truck, however, met with an accident in West Bengal on 27.6.1993. The Company was informed about this by the complainant on 15.7.1993 He has also submitted statement of claim to the INsurance Company. The Complainant got impatient when his case was not disposed off by the respondent Company even after lapse of 2 months when he filed this complaint. IN the objections the learned Counsel for the respondent has stated that there was no deficiency of service committed by the respondent Company and therefore argued that the present complaint was not maintainable.

WE heard the arguments about this point today. On perusal of the file it appears that the respondents had been prepared to meet the demands of the complainant and look after into the matter brought to their notice but in view of the fact that the complainant was impatient and wanted to get the whole matter settled within 2 months only which was not possible under the normal course of business. In view of the pleadings and the arguments we heard, we feel that the petition could be disposed off with the direction to the respondent to attend to the case of the complainant and dispose off the same within 5 months from today. The Company shall specially attend to this case and should endeavour to dispose off the case within the time mentioned above. The learned Counsel for the respondent has been also impressed to make the respondent company to attend to this case and make sure that the whole case is disposed off by them within the period given above. If the case is not disposed off within the period mentioned above or any other grievances, the complainant may approach this Commission again. The complainant is, however, directed to go to the Company''s Regional Office on 17.2.1994 and also cooperate with the respondent company in finalization of his claim. The petition is as such accordingly disposed off. Petition disposed of.
