Judgment
B.S. Verma, J.—Heard Mr. Siddharth Bisht, Advocate for the petitioner and Mr. Rajendra Dobhal, learned Senior Advocate on behalf of the respondents.
By means of this petition the petitioner has sought a writ in the nature of mandamus directing and commanding the respondents to give admission to the petitioner in her desired course, i.e. B.Sc. Agriculture in accordance with the preference given by the petitioner.
According to the petitioner about 25 seats are lying vacant in the second semester of B.Sc. Agriculture
The petitioner is studying in first semester of B.Sc. Home Science. The submission of counsel for the petitioner is that since some seats have fallen vacant in second semester of B.Sc. Agriculture, due to the reason that some students after taking admission, have left the university and have taken admission some-where else, therefore, petitioner may be given admission in second semester B.Sc. Agriculture. The above averment has been made by the petitioner on the basis of information sought under the R.T.I. Act from the University.
During the course of argument learned Counsel for the petitioner has prayed that respondent No. 2, the Coordinator (Admission) G.B. Pant University be directed to decide the representation of the petitioner. It is to be stated here that after the admission process is over the role of the Coordinator has come to an end, therefore, the representation of the petitioner may be decided by the Registrar of the University.
Therefore, the petitioner is given liberty to make representation before the respondent No. 3, Registrar,G.B. Pant University of Agriculture and Technology, Pantnagar, for the redressal of his grievance. If such a representation is made, the respondent No. 3 shall take a decision on the representation made by the petitioner by a reasoned and speaking order, in accordance with law, preferably, within a period of three weeks from the date of making the representation, along with certified copy of this order.
With the aforesaid observation, the writ petition is disposed of finally.
