According to learned counsel for the appellant, present application has been rendered infructuous. Same is dismissed as such.

Present appeal is directed against the order passed by Principal Judge, Family Court, Panipat, whereby application of the appellant for interim custody of the child has been dismissed.
As the matter is still pending before the court below, this court does not find any reason to entertain the present appeal. Same is hereby dismissed. However, at this stage, learned counsel for the appellant has prayed that a direction be issued to the court below to decide the matter expeditiously and the observations made in the order be not taken into consideration. We hereby direct that the Family Court, Panipat shall make endevour to conclude the proceedings expeditiously, preferably within a period of five months. It shall not be swayed by the observations made in the interlocutory orerwhich is under challenge in this appeal.
