Judgment

This Court earlier directed by order dated 18.10.2022 to the Commissioner for Employee’s Compensation-cum-Assistant Labour Commissioner, Berhampur to submit his report stating reasons for not sending the LCR to this Court despite repeated directions.
Today the LCR is produced by Mr. P. Bharadwaj, learned A.S.C. without any report of the learned Commissioner. Further an affidavit sworn by one Prasant Sahoo, Statistical Assistant (Clerk) in the Office of the Commissioner for Employees Compensation-cum-Assistant Labour Commissioner, Berhampur is filed, wherein it is stated by said Prasant Sahoo on behalf of the Commissioner that no such letter/instructions has been received for production of the LCR.
The affidavit sworn by the Statistical Assistant on behalf of the Commissioner is not found satisfactory and thus rejected.
Learned Commissioner for Employees Compensation-cum-Assistant Labour Commissioner, Berhampur (I/C), namely, Madan Mohan Paik (name suggested by Mr. Bharadwaj), is directed to appear in person before this Court on 29th November, 2022 at 10.30 a.m. to explain the reasons for not sending the LCR to this Court in time and not submitting his report.
List this matter on 29th November, 2022.
A copy of this order be handed over to Mr. Bharadwaj, learned A.S.C. without delay for onward communication.
An urgent certified copy of this order be granted on proper application..
