The matter is taken up through hybrid mode.
Heard Mr. G.P. Dutta, learned counsel for the insurer-Appellant and Mr. B.K. Behera-1, learned counsel for claimant – Respondent No.1.
The claimant – Respondent No.1 appears in person in pursuance to the direction of this court dated 8th August, 2022 and files the affidavit. In his affidavit at paragraph 10, the claimant admits that he made such admission before the Commissioner about renewal of his DL in the year 2009 till 20th May, 2012.
Mr. Dutta, learned counsel for the insurer files the extract of the driving licence No.47/85/86 issued by the RTO, Cuttack and submits that it is the copy of the same document filed by the claimant before the Commissioner which clearly reveals that the claimant renewed his D.L. in respect of transport vehicle from 21st May, 2009 to 20th May, 2012 and in respect of non-transport vehicle from 21st May, 2009 to
The claimant submits that he has not filed any such document before the Commissioner.
In view of the conflict, call for the copy of LCR in W.C. Case No.67 of 2009 from the court of Commissioner for Employee’s Compensation-cum-Assistant Labour Commissioner, Berhampur, Ganjam before the next date. Registry is directed to get the same before the next date.
The personal appearance of the claimant – Respondent No.1 is dispensed with.
