Judgment
Counsel appearing for the respondent submits that they have already issued show cause notice upon an officer of Department of Telecommunications (DoT). But the counsel for the respondent is unable to give any name and he has submitted that show cause notice has been issued on a post and not upon a person. It appears that the respondent do not want take any action against their own erring officer(s)
We, therefore, direct the Secretary, Department of Telecommunications (DoT) to take action against the erring officer(s) and file an affidavit that what action has been taken against which officer for not lodging the claim of approximately Rs.67 Lakhs against the petitioner Company.
Despite our order dated 21.12.2023 till today no action has been taken against any erring officer by DoT. Such a lethargic officer who has not taken action should have been suspended much earlier by the DoT and as DoT is not taking action we have to pass this order. Too much brotherhood is an offence.
A copy of this order shall be sent by the Registry to –
(i) Hon’ble The Minister of Communications.
(ii) Secretary, Department of Telecommunications (DoT), New Delhi.
This matter is, therefore, adjourned to 22.8.2024.
