Judgment
Counsel appearing for the respondent is seeking time to decide an application preferred by the petitioner for migration of the licenses. It is submitted by counsel appearing for the petitioner that since 20.4.2023 application for migration of as many as six licenses were preferred for six service areas and, thereafter, even online applications have also been preferred as per the guidelines given by the respondent and that too it was in the month of December, 2023 and the respondent are sitting tight upon the migration application preferred by the petitioner since then. Time, as prayed for, is granted to the Union of India till the next date of hearing.
Meanwhile, no coercive steps shall be taken by the respondent and moreover till the next date of hearing the licenses issued to the petitioner shall be deemed to have been in operation till the next date of hearing.
We also hereby restrain the respondent from withdrawal of the spectrum holdings of the petitioner till next date of hearing.
This interim relief shall continue to be operative till the next date of hearing.
The matter is, therefore, adjourned to 8.8.2024.
