Judgment
Case taken up. Learned Counsel for one of the Directors, Mr Deepak Sharma, as well as Petitioner, are present. Rest of the two Directors who had taken time for filing reply two times, are neither present, nor being represented by any Counsel.
Though, there had been Bailable Warrant issued against them, and in response to same, one Director Mr. Deepak Sharma, had appeared and rest two had claimed for time. But, the Police Report reveals, that those two Directors were neither served with Warrant, nor their warrant Bonds are there. They are not traceable at given address.
Learned Counsel for Petitioner is requesting for a short time for collecting the update address and taking steps. Though, it was mentioned by him that it is a deliberate avoidance by those two Directors, but, anyway service is to be there.
If there is deliberate avoidance, then it may be brought on record, by oath, with categorical assertion of the address of those Directors, to be correct one and update. Let it be filed, within three weeks.
List the matter on 07.10.2024 “for further directions”.
