Judgment

Heard Mr. P. Roy Barman, learned senior counsel assisted by Mr. S. Bhattacharjee and Mr. K. Nath, learned counsels appearing for the petitioner. Also heard Mr. D. Bhattacharjee, learned G.A. assisted by Mr. S. Saha, learned counsel appearing for the State-respondents.
At the outset this court must appreciate the active and valuable assistance rendered by learned Advocate General of the State, Mr. T. Datta Majumder, learned senior counsel and Mr. Somik Deb, learned senior counsel appearing as amicus curiae to resolve the material questions raised in this writ petition as regards the determination of percentage of reservation in filling up of Government posts qua the mode of reservation as prescribed under state’s SCs and STs Reservation Act and Rules.
By way of filing the present writ petition, the petitioner has challenged the recruitment process for filling up 230 numbers of posts of Post Graduate Teachers (PGT), particularly, the reservation of posts, which according to the petitioner goes beyond the limit of 50%. It appears that out of 230 posts, 201 nos. of posts have been kept reserved for Schedule Castes and Schedule Tribes which apparently is in excess of 50%.
It is notified that the written test would be held on 11.09.2022. In this view of the matter, let the process goes on, but, the respondents are directed not to declare the results of the examination and the question of determining the number of reserved posts shall be subject to the decision of the writ petition.
This order has been passed as an interim measure.
List the matter on 23.09.2022 in Division Bench-IV along with WA No.458/2020 and WA No.460/2020, which involves similar and identical questions.
