Judgment
Vide order dated 22/26.2.2013, the respondents transferred the petitioner from Regional Office, Directorate of Advertising & Visual Publication, Guwahati to the Directorate of Advertising and Visual Publication, New Delhi. Aggrieved, the petitioner challenged the order dated 22/26.2.2013 before the Tribunal by filing O.A. No.73/2013. But the Tribunal did not agree with the petitioner and dismissed his Original Application vide order dated 11.11.2014. Dissatisfied with the order of Tribunal, the petitioner has filed the present petition.
The record reveals that by an interim order dated 23.1.2015, this court has stayed the operation of order dated 22/26.2.2013. In the result, the petitioner is continuing in the Regional Office at Guwahati.
The learned Assistant Solicitor General of India states that since now more than 4 years have passed, after passing of order dated 22/26.2.2013, it has lost its relevance and, therefore, same be quashed and respondents be granted liberty to pass fresh order in accordance with law. To this prayer, the learned counsel for the petitioner has fairly agreed.
In view of the aforesaid, with the consent of the respective counsel for the parties, we quash the order dated 22/26.2.2013. We, however, make it clear that the respondents will be at liberty to pass fresh transfer order of the petitioner in accordance with law.
The petition stands finally disposed of.
