Heard Mr. Somik Deb, learned senior counsel assisted by Mr. A. Baran, learned counsel appearing for the appellant. Also heard Mr. R. Datta, learned P.P. assisted by Mr. S. Debnath, learned Additional P. P. appearing for the State-respondent.

This is an application under Section 438 of the Code of Criminal Procedure, 1973, for granting of pre-arrest bail, in favour of the petitioner, in connection with Khowai PS case no. 2021 KHW 052 registered under Sections 409 and 420 of the Indian Penal Code, 1860.

It is stated in the FIR that the petitioner has misappropriated government funds provided to her for implementation of various government schemes through the NGO of the petitioner. The petitioner has submitted utilization certificate time to time. However, the FIR maker found discrepancies in the utilization certificates and the fund provided by the Government.

Mr. R. Datta, learned P. P. has submitted that the certificates produced by the petitioner are all fake, and the petitioner has also been booked in connection with other cases.

In view of the submissions of learned counsel appearing for the parties, I direct the petitioner to surrender before the Investigating Officer on 08.07.2022 at 11:00 a.m. with all the necessary papers/documents to convince the Investigating Officer that she utilized the funds provided by the Government under various schemes.

The Investigating Officer shall carry out a detailed investigation on all the papers, which are submitted by the petitioner and will proceed further in accordance with law. The petitioner is also directed to co-operate with the process of investigation in all respects.

With this observation and direction, the instant application stands disposed of.
