Heard Mr. N. Alom, learned counsel appearing for the petitioner and Mr. B.B. Goswami, learned Addl. P.P. for the State of Assam.

This is an application under Section 438 Cr.P.C. filed by the petitioner, namely, Sri Dipak Dey praying for pre-arrest bail in the matter of Paltan Bazar

P.S. Case No. 630/2021 under Section 8 of the Prevention of Corruption Act.

The informant herein is the AGM (Law) of APDCL at Guwahati. In his FIR, he has alleged that the present petitioner, who is an employee of M/s.

M.M. Concact, came to his office and out one envelope inside his diary. According to the informant, after that incident, the petitioner immediately left

his office.

The case diary reveals that M/s M.M. Concact has some sort of official relationship with APDCL. The case diary further reveals that the aforesaid

envelope contain a cash amount of Rs. 10,000/-.

Mr. Alom, learned counsel for the petitioner submits that the petitioner being an employee of M/s M.M. Concact, simply carries the instruction of his

masters and he even did not know about the contents of the envelope.

It appears from the case diary that the matter is in initial stage of investigation. It is an allegation of corruption in public service. Therefore, this court is

of the opinion, if the bail application of the present petitioner is allowed, it would amount to interference in police investigation and on this ground, the

pre-arrest bail of the petitioner is rejected.

The bail application is disposed of accordingly.
